Why Indian people need the fundamental right to choose their partner

In India though fundamental rights are not totally protected but they have a recognizable importance. The preventive nature of fundamental rights makes them a sole sword against the anarchy in our society. The historically important article 21 has proved a great deal in deciding and securing protection of life and personal liberty of an individual.

Fundamental rights have provided democracy with many laws which holds the basic fabric of a nation. The Supreme court's timely contribution in deriving meaning out of lines has proved a great deal of importance. Though fundamental rights have discovered many areas of human life still there is a need to invent some other aspects. One of such is of giving a right to choose a partner to young women and men.

This becomes important since our society saw an anarchist cases of honor killing and violence's. The recent one was in West Bengal, which I think needs to look beyond that of Nirbhaya's case. This is because a girl was asked to be harassed by anyone in the village just because of her involvement in love affair with a boy of some other community. A stage was being built out of bamboos in the middle of village so that whole people including women could watch that heinous act. This was the most heinous incidences which have rocked West Bengal and in turn to the India.

The main question is as why there is steep difference between Indian libelers and conservatives? And why some young beautiful couples are chastised for their confrontation with conservative values? If we look at our history then we can certainly decide that these ideas of cast based orientation was not precedent in India.. The first major known civilized community i.e  Harrappan civilization was far away from immoral values. Harrapans were atheist and liberals who did not believe in cast system.

Upto the early Vedic period everything was fine in India, though Aryans of this period were outsiders. Even Brahmin's of early Vedic period strongly believed in Gandharva Vivah in which a guy and a girl was permitted to marry without the consent of family or society. However, as the caste system became rigid during the later Vedic period, then even liberal Brahmans could not escape from the havocs of rigid marriage system. The concept of Brahma Vivah became popular and used  to be considered as superior. In this type of marriage a boy and girl's parents used to meet and decide as what is superior for their boy or a girl. Thus the rigidity of caste system forced Indian subcontinent to hold illogical and conservative marriage system.

It is a well known fact in modern biotechnology that the most diverse species can only survive. The more is the diversification the more is the capability of the species to counter the attacks of paste. Now, similar concept is applied and implicit in human case. The more diverse is our generation the more we will become insusceptible from modern day diseases. This can only be achieved through inter-caste marriages. This becomes important specially when scientist are fearing the attacks new kind of viruses. The liberals from India have to find new ways of ensuring the importance of diverse generation.

We have to understand that out of 2500 movies released in India more than 90% are the love stories. The movies, novels and plays are the mirrors of society. If 90% people love the ultimate love stories then we don't need rocket science to confirm that the urge to choose our life partner exists. Indian society is already on a way of becoming liberal one.

It's just the prejudices and certain preconceived notions due to ignorance that are holding it back. The generation next cant attack a girl for a night just because she is  chosen by parent's mutual consent. For this we need a law so that next Virbhum like cases of West Bengal should not happen again. We need a law for empowering the women of this society. The best step would come if we convert that 'urge' into fundamental right so that courts across India can defend it.
